Both the beneficiary and the trustee have elected to sell the real property to satisfy the obligations secured by the trust deed and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.735(3); the default for which the foreclosure is made is grantor's failure to pay when due the following sums: monthly payments of $790.13 beginning 02/01/06; plus late charges of $25.47 each month beginning 02/16/06; plus prior accrued late charges of $0.00; plus advances of ($575.62); together with title expense, costs, trustee's fees and attorney's fees incurred herein by reason of said default; any further sums advanced by the beneficiary for the protection of the above described real property and its interest therein; and prepayment penalties/ premiums, if applicable.

Park Plaza at McKenzie Park

Sealed bids for the reconstruction of a Park Plaza at McKenzie Park, shall be submitted to the City Recorder, City of Hermiston, 180 N.E. 2nd Street, Hermiston, Oregon 97838, no later than 1:00 pm on Thursday, May 24, 2007. No bids will be received after this time.

The bids shall be opened publicly and read aloud by the City beginning at 1:00 p.m., Thursday, May 24, 2007, in the Hermiston City Council Chambers, 180 N.E. 2nd Street, Hermiston, Oregon. No facsimiles will be accepted . The submittal envelope shall state the bidder's name and all be marked "Sealed bid for Park Plaza at McKenzie Park" or similar wording.

The Contract Documents may be examined and/or purchased for a non-refundable fee of $10 at the Hermiston City Hall, 180 N.E. 2nd Street, Hermiston, OR 97838; phone 541-567-5521.

Each bid shall be accompanied by a bid bond, a certified check or cashier's check made payable to the "City of Hermiston" in the amount of not less than five percent (5%) of the bid amount. The bid bond/check shall be given as a guarantee that the bidder will execute the contract, if it be awarded, in conformance with the Contract Documents.

The proposed project consists of construction of a Park Plaza at McKenzie Park.

The award of the Contract shall be made to the qualified bidder submitting the lowest responsive total bid in the proposal. The City of Hermiston reserves the right to reject any or all bids or to waive irregularities or informalities in any bid or in the bidding. The City reserves the right to withhold the Notice to Proceed up to 30 days after the Notice of Award. No bidder may withdraw its bid after the time fixed for the opening of the bids, or before the award of the Contract, unless said award is delayed for a period exceeding forty two (42) days.
