Whereas, the City of Hermiston has received an Oregon Community Development Grant and;

Whereas, the City of Hermiston has certified in its grant contract with the state that it will comply with requirements of Title VIII of the Civil Rights act of 1968, as amended, and will take action affirmatively to further fair housing.

The City Council of the City of Hermiston did pass the following resolutions on the dates signified.

Resolution no. 1826

A Resolution establishing grievance procedure for complaints of alleged discrimination based on disability.

Be it resolved that complainant may submit complaint in writing to the City Manager for resolution. A record of the complaint and action taken will be maintained. A decision by the disgnated official will be rendered within 15 working day.

Be it further resolved if the complaint cannot be resolved to the complainant's satisfaction by the designated official, the complaint will be heard by the City Council and discussed at an open, public meeting of the elected body. A written decision will be made within 30 working days. The decision of City Council of the City of Hermiston is final. A record of the action taken on each complaint will maintained as part of the records or minutes at each level of the grievance procedure.

The effective date of the resolution shall be February 12, 2008.

Let it be known to all persons of the City of Hermiston that discrimination in the sale, rental, lease, advertising of sale, rental or lease, financing of housing or land to be used for construction of housing, or in the provision of brokerage, rental services because of race, color, sex, disability (physical or mental), familial status (children) or national origin is prohibited by Title VIII of the federal Fair Housing Amendments Act of 1988. It is the policy of the City of Hermiston to support the Fair Housing Amendments Act of 1988 and to implement a Fair Housing Program to ensure equal opportunity in housing for all persons regardless of race, color, religion, sex, disability (physical and mental), familial status (children) or national origin. Therefore, the City of Hermiston does hereby pass the he following Resolution:

Be it resolved that within the resources available to the City of Hermiston through city, county, state, federal and community volunteer sources, the City will assist all persons who feel they have been discriminated against because of race, color, religion, sex, disability (physical and mental), familial status (children) or national origin in the process of filing a complaint with the Oregon Civil Rights Division or the U.S. Department of Housing and Urban Development, Seattle Regional Office Compliance Division, that they may seek equity under federal and state laws.

Be it further resolved that the City shall publicize this Resolution and through this publicity shall cause real estate brokers and sellers, private home sellers, rental owners, rental property managers, real estate and rental advertisers, lenders, builders, home buyers and home or apartment renters to become aware of their respective responsibilities and rights under the Fair Housing Amendments Act of 1988 and any applicable state or local laws or ordinances.

The Fair Housing Program, for the purpose of informing those affected of their respective responsibilities and rights concerning Fair Housing law and complaint procedures, will at a minimum include, but not be limited to: 1) the printing, publicizing and distribution of this Resolution; 2) the distribution of posters, flyers, pamphlets and other applicable Fair Housing information provided by local, state and federal sources, through local media of community contacts; and 3) the publicizing of location where assistance will be provided to those seeking to file a discrimination complaint.

The Effective Date of this Resolution shall be October 24, 2000.

A resolution expressing the intent and commitment of the city of Hermiston to insure equal opportunity in employment and the city's policy of nondiscrimination on the basis of handicapped status.

Be it resolved as follows:

Section 1. Title. This resolution shall be known and may be cited as an Equal Employment Opportunity and Nondiscrimination on the Basis of Handicapped Status Resolution of the City of Hermiston.

Section 2. Adoption of Equal Employment - Handicapped Policy. The governing body of the City of Hermiston hereby declares it to be the policy of the City of Hermiston to assure fair treatment of applicants and employees in all aspects of personnel administration without regard to political affiliation, race, color, national origin, sex, handicap or religious creed, and with proper regard for their privacy and constitutional rights as citizens.

Section 3. Policy Application. This policy shall generally prevail throughout all aspects of personnel management including but not limited to the following:

a. Recruiting, selecting and advancing employees on the basis of their relative ability, knowledge and skills.

b. Recruiting, selecting and advancing employees without regard to political affiliation, race, color, national origin, sex, handicap or religious creed, except where sex, age or national origin is a bona fide occupational qualification.

c. All other aspects of personnel administration such as compensation, benefits, transfers, layoffs, returns from layoffs, training, education, social and recreational programs will be administered without regard to political affiliation, race, color, national origin, sex, handicap or religious creed.

d. The City of Hermiston will undertake a program of affirmative action to make widely known, especially to minorities and handicapped, that employment opportunities are available on the basis of individual merit and to actively encourage all persons to seek employment and to strive for advancement on the basis.

e. The City of Hermiston annually will conduct a survey and an analysis of the employee work force to ascertain what measures, if any, may be needed to effectively maintain conformance with this equal opportunity and handicapped policy.

Section 4. Coordinator. The City Manage shall be the coordinator. The City Manager may delegate any of the powers, duties or responsibilities associated with the appointment to any other officer or employee of the city.
