The undersigned hereby certifies that he has no knowledge of any assignments of the Trust Deed by the Trustee or by the Beneficiary or any appointments of a Successor Trustee other than the appointment of Jeffrey C. Gardner, Esquire, as successor trustee, except as recorded in the property records of the county in which the real property described above and in Exhibit A attached hereto is situated. Further, the undersigned certifies that no action has been instituted to recover the debt, or any part thereof, now remaining secured by the Trust Deed. Or, if such action has been instituted, it has been dismissed except as permitted by ORS 86.735(4).

More particularly, the Grantors have (A) failed to pay, when due, certain real property taxes due for the 2004 ñ 2005, 2005 ñ 2006, and 2006 ñ 2007 tax years in the total amount of $10,307.23 together with accrued and accruing interest thereon, and

(B) defaulted in their payment and performance obligations to Beneficiary and are in continuing and uncured default by reason of their failure to pay to Beneficiary in response to Beneficiary's written acceleration and demand for payment, when and in the amounts due, the following sums which were due and owing to Beneficiary as of November 13, 2006:

Accordingly, the sum owing on the obligation secured by the Trust Deed and the Real Property

interest accruing on the principal portion of that amount from and after November 14, 2005 at a

rate that is currently 12.75 percent per annum ($294.02 per diem) plus additional costs and

expenses incurred by Beneficiary (including Beneficiary's attorney's fees, costs, and expenses).

Notice is hereby given that the Beneficiary, by reason of the defaults described above, has elected and does hereby elect to foreclose said Trust Deed by advertisement and sale pursuant to ORS 86.735 et seq., and to cause to be sold at public auction to the highest bidder for cash, the Grantors' interest in the subject Real Property described in Exhibit A attached hereto, which the Grantors had, or had the power to convey, at the time the Grantors executed the Trust Deed in favor of the Beneficiary, along with any interest the Grantors or the Grantors' successors in interest acquired after the execution of the Trust Deed, to satisfy the obligations secured by the Trust Deed as well as the expenses of the sale, including compensation of the Trustee as provided by law, and the reasonable fees of Trustee's attorneys.

The sale will be held at the hour of 10:00 o'clock a.m., in accordance with the standard of time established by ORS 187.110, on the 11th day of April, 2007, at the main entrance of the Umatilla County Courthouse, at 216 Southeast 4th Street,

Pendleton, Oregon 97801, which is the hour, date and place last set for the sale.

RIGHT OF REINSTATEMENT:

Notice is further given that any person named in ORS 86.753 has the right, at any time prior to five (5) days before the date last set for the sale, to have this foreclosure proceeding dismissed and the Trust Deed satisfied by (A) payment to the Beneficiary of the entire amount then due (an amount that is not less than $973,428.41 as of (through and including) November 13, 2006, together with additional accruing interest plus such additional costs and expenses as may be incurred by the Beneficiary and/or the Trustee, other than such portion of the principal as would not then be due had no default occurred, together with the costs and expenses actually incurred in enforcing the terms of the obligation, as well as Trustee and attorney fees as prescribed by ORS 86.753, and (B) payment in full of all real property taxes now due and/or past-due with respect to the Real Property, in an amount that is not less than $10,307.23 as of the date of this notice.
