TRUSTEE'S NOTICE OF SALE

Reference is made to the deed of trust made by Juan Cardoza and Evelinda Cardoza, as grantors, to John W. Weil, as successor trustee, in favor of Oakwood Acceptance Corporation, as beneficiary, dated January 22, 2001, recorded January 24, 2001, as Instrument No. 2001-3820044 in the Records of Umatilla County, Oregon, which deed of trust was duly assigned to Vanderbilt Mortgage and Finance, Inc., servicer for Chase Manhattan Trust Company NA, by assignment recorded August 13, 2001 Instrument No. 2001-3950240 in the Records of Umatilla County, Oregon, covering the following described real property situated in said county and state, to wit:

Tract I:

Parcel 3, PARTITION PLAT NO. 1999-51, filed November 5, 1999, Instrument No. 1999-3600754, Office of County Records, Umatilla County, Oregon, located in the Southeast Quarter of Section 36, Township 5 North, Range 28, East of the Willamette Meridian, County of Umatilla, State of Oregon.

Subject to any and all water rights of way and roads.

Tract II:

TOGETHER WITH 30 foot non-exclusive easement for road purposes, the South line of said easement being described as follows:

Beginning at the Southwest corner of the herein above described tract; thence North 89 35' 19" West a distance of 1305.20 feet more or less to the East right of way line of County Road No. 729 aka 1267 and the point of terminus of this line description.

Both the beneficiary and the trustee have elected to sell the said real property to satisfy the obligations secured by said trust and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.735(3); the default for which the foreclosure is made is grantor's failure to pay when due the following sums:

Failure to make monthly payments of $1,122.31 each due on the 1st day of April, 2006 through January 4, 2007.

By reason of said default the beneficiary has declared all sums owing on the obligation secured by said deed of trust immediately due and payable, said sums being the following, to-wit:

$139,513.61 plus $10,369.49 interest, late charges and miscellaneous fees through January 15, 2007; plus 8.5% interest thereon; plus attorney and trustee's fees and costs; plus $570.00 foreclosure guaranty.

WHEREFORE, notice hereby is given that the undersigned trustee will on June 8, 2007 at the hour of 11:00 o'clock, A.M. in accord with the standard of time established by ORS 187.110, at the Umatilla County Courthouse, located at 915 SE Columbia Drive, Hermiston, OR 97838, sell at public auction to the highest bidder for cash the interest in the said described real property which the grantor had or had power to convey at the time of the execution by grantor of the said trust deed, together with any interest which the grantor or grantor's successors in interest acquired after the execution of said trust deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.753 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or trust deed, and in addition to paying said sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and trust deed, together with trustee's and attorney's fees not exceeding the amounts provided by said ORS 86.753.

In construing this notice, the singular includes the plural, the word "grantor" includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by said deed of trust, and the words "trustee" and "beneficiary" include their respective successors in interest, if any.

(after release from stay)

Reference is made to that certain Deed of Trust made by STACY L. PIERCE, as Grantor, to AMERITITLE, as Trustee, in favor of BANNER BANK OF OREGON, as Beneficiary, dated June 12, 2001, recorded June 13, 2001 as Document Number 2001-391-3910052, Office of County Records, Umatilla County, Oregon, covering the following described real property situated in said county and state, to wit:

Lot 5, Block 1, KIRK'S 4TH ADDITION to the Town, now City of Athena, Umatilla County, Oregon.

The beneficial interest was assigned to Oregon Housing and Community Services Department, State of Oregon by that certain Assignment of Deed of Trust recorded June 13, 2001 as Document No. 2001-3910053, Office of County Records, Umatilla County, Oregon.

Both the beneficiary and the trustee have elected to sell the said real property to satisfy the obligations secured by said trust deed and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.735(3); the default for which the foreclosure is made is grantor's failure to pay when due the following sums:

Monthly installments of $653.00 each, commencing with the payment due May 1, 2006 and continuing each month until the trust deed is reinstated or goes to Trustee's sale; plus monthly late charges of $25.98 each beginning May 16, 2006 until paid; plus accrued and unpaid late charges; plus all fees, costs and expenses associated with this foreclosure; less a partial payment of $108.83.

By reason of said default the beneficiary has declared all sums owing on the obligation secured by the trust deed immediately due and payable, said sums being the following, to wit:

The sum of $79,971.05 with interest thereon at the rate of 6.125% per annum from April 1, 2006, until paid; plus monthly late charges of $25.98 each beginning May 16, 2006, until paid; plus accrued and unpaid late charges; plus all fees, costs and expenses associated with this foreclosure; all sums expended by beneficiary to protect the property or its interest therein; and less sums, if any, in reserve accounts.

The notice of default and original notice of sale given pursuant thereto stated that the property would be sold on January 19, 2007, at the hour of 10:00 o'clock A.M., in accord with the standard of time established by ORS 187.110, at Law Office of David Wm. Hadley, 130 SE 3rd Street in the City of Hermiston, County of Umatilla, State of Oregon; however, subsequent to the recording of said notice of default the original sale proceedings were stayed by order of the court or by proceedings under the National Bankruptcy Act or for other lawful reason. The beneficiary did not participate in obtaining such stay. Said stay was terminated on January 16, 2007 by virtue of an Order of Discharge of Debtor granted by the United States Bankruptcy Court, Western District of Washington.

WHEREFORE, notice hereby is given that the undersigned trustee will on March 30, 2007, at the hour of 10:00 o'clock, A.M., in accord with the standard of time established by ORS 187.110, at Law Office of David Wm. A Resource Conservation and Recovery Act (RCRA) Hazardous Waste Storage and Treatment Permit was issued February 1997, to the U.S. Army for the operation of a hazardous waste incineration facility at the Umatilla Chemical Depot (UMCD) near Hermiston, Oregon. The Umatilla Chemical Agent Disposal Facility (UMCDF) is currently operating. A separate RCRA Hazardous Waste Storage Permit was issued January 2005, to the U. S. Army for the ongoing storage of chemical agent munitions and bulk items, as well as other hazardous wastes generated from management of the chemical weapons stockpile. The Oregon Department of Environmental Quality (DEQ) has a complete list of modifications to both the UMCDF hazardous waste permit (Permit No. ORQ 000 009 431) and the UMCD hazardous waste permit (Permit No. OR6 213 820 917) that have been approved by the Environmental Quality Commission or the DEQ since each of these two permits were issued.
